FaceBash – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the FaceBash mobile application and website facebash.app (collectively, the “Services”), operated by Tech G Labs LLC, a Texas limited liability company (“Tech G Labs LLC”, “we”, “us”, or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

By using FaceBash, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding contract;
• You are not prohibited from using the Services under any applicable law; and
• You will comply with these Terms and all applicable laws and regulations.

You may not upload photos of anyone under 18 or otherwise involve minors in the Service.

2. Accounts and Security

To use certain features, you may need to create an account.

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us if you suspect any unauthorized use of your account.
• We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in harmful or illegal behavior.

3. User Content

“User Content” means any content you upload, post, submit, or otherwise make available through the Services, including photos, comments, captions, ratings, and any other text or media.

3.1 Your Responsibilities

You are solely responsible for your User Content and for any consequences of posting or sharing it. By submitting User Content, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to use and share the User Content;
• You have obtained any necessary consents from individuals appearing in the photos;
• The individuals shown are 18 years or older;
• Your User Content does not infringe or violate any third-party rights, including privacy, publicity, copyright, or trademarks;
• Your User Content complies with these Terms and all applicable laws.

We do not endorse or guarantee the accuracy, quality, or reliability of any User Content posted by users.

3.2 Prohibited Content

You agree that you will not upload, post, or share:

• Any image or content depicting a minor (under 18);
• Nudity, sexually explicit content, or content intended to sexually exploit or objectify another person;
• Content that is hateful, harassing, bullying, threatening, or encourages self-harm or violence;
• Content that is discriminatory or incites hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
• Content that includes illegal activities, terrorism, or incitement to crime;
• Content that violates intellectual property, privacy, or publicity rights;
• Spam, scams, misleading or fraudulent content;
• Malicious code, viruses, or attempts to hack or interfere with the Services.

We may, at our sole discretion, remove or restrict any User Content that we believe violates these Terms or is otherwise harmful or inappropriate.

4. License You Grant to Us

By submitting User Content, you grant Tech G Labs LLC a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:

Use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with operating, improving, promoting, and providing the Services.

This license persists for as long as your User Content is stored on our systems, and for a reasonable period thereafter to back up, audit, or comply with legal obligations.

You retain any ownership rights you have in your User Content, subject to the rights you grant in these Terms.

5. Content Moderation and Removal

We have no obligation to monitor all User Content, but we reserve the right to:

• Remove or disable access to any User Content;
• Suspend or terminate accounts;
• Block or restrict access to all or part of the Services,

if we believe, in our sole discretion, that content or behavior violates these Terms, our policies, or applicable law, or that it may harm FaceBash, Tech G Labs LLC, our users, or the public.

We may also cooperate with law enforcement in investigating suspected illegal activity.

6. Intellectual Property of FaceBash

The Services, including all software, design, graphics, text, logos, and other materials (excluding User Content), are owned by or licensed to Tech G Labs LLC and are protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Services, in whole or in part, unless expressly permitted by us.

All trademarks, logos, and service marks displayed in the Services are the property of Tech G Labs LLC or their respective owners.

7. Acceptable Use

You agree that you will not:

• Use the Services for any illegal purpose or in violation of any law;
• Harass, threaten, or harm another person;
• Attempt to gain unauthorized access to any account, system, or network;
• Attempt to reverse engineer, decompile, or otherwise derive the source code of the Services (except to the extent this is allowed by law);
• Use any automated system (e.g., bots, scrapers) to access or interact with the Services without our permission;
• Interfere with or disrupt the operation of the Services or the servers or networks that host them.

We may investigate and take legal action against violations of this section.

8. Ratings, Age Guesses, and Disclaimers

FaceBash is a social, entertainment-focused platform. The ratings, comments, and age guesses are generated by users and are subjective.

• Ratings, comments, and age guesses do not represent the views of Tech G Labs LLC.
• FaceBash does not provide any medical, psychological, or professional advice.
• You should not rely on ratings or comments for any decisions relating to health, self-esteem, employment, or relationships.
• If you find the Service negatively impacts your well-being, you should stop using it and, if needed, seek support from friends, family, or a professional.

9. Third-Party Links and Services

The Services may contain links to third-party websites, apps, or services.

We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if:

• You violate these Terms or any other policies;
• You engage in behavior that we believe is harmful, illegal, or unsafe;
• We decide to discontinue the Services.

You may stop using the Services at any time. You may also delete your account through the App, where available, or contact us at support@facebash.app for assistance.

Upon termination, certain sections of these Terms will continue to apply, including, but not limited to, User Content, Intellectual Property, Disclaimers, Limitations of Liability, and Governing Law.

11. Disclaimers

Your use of the Services is at your own risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Services will be uninterrupted, error-free, secure, or free from harmful components;
• Any warranty regarding the accuracy, reliability, or completeness of User Content.

We do not control or endorse User Content and are not responsible for any harm resulting from it.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by law:

• Tech G Labs LLC, its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Services.
• Our total liability to you for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:
  • The amount you paid, if any, to use the Services in the 12 months prior to the claim; or
  • One hundred U.S. dollars (USD $100).

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Tech G Labs LLC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your use of the Services;
• Your User Content;
• Your violation of these Terms; or
• Your violation of any rights of another person or entity.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles.

You agree that:

• Any legal action or proceeding arising under or related to these Terms will be brought exclusively in the state or federal courts located in the State of Texas, and
• You consent to the personal jurisdiction and venue of those courts.

If you are located in a jurisdiction that requires consumer disputes to be handled differently, these provisions will apply only to the extent permitted by that jurisdiction’s laws.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top. For significant changes, we may also provide additional notice in the App or by email.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
